While I can provide you with a general checklist, please be advised that the most definitive and up-to-date requirements will always come directly from the Register of Deeds (RD) where the property is located. Requirements can sometimes have minor variations or additional nuances depending on the specific RD office's internal procedures.
Therefore, for the most accurate and current information, it is strongly advised that you contact or visit the Register of Deeds office located in the province or city where your agricultural land is situated.
Below is a general checklist of requirements typically needed for the registration of an Extra-Judicial Settlement of Estate:
- Original Deed of Extra-Judicial Settlement of Estate with stamp from BIR;
(If original document cannot be presented, the duplicate original of certified true copy shall be presented together with the sworn affidavit executed by the interested party stating why the original document be submitted.)
2. Original Owner's Duplicate Copy of Title;
3. Certificate Authorizing Registration (CAR) from BIR;
4. Transfer Tax with Security Seal and Certification;
5. Real Property Tax Clearance (Treasurer's Office where property is located):
6. Certified Copy of the Latest Tax Declaration (Assessor's Office)
7. Affidavit of Publication of Settlement;
8. Special Power of Attorney (if necessary):
9. Presenter's ID (photocopy)
*Note:
- Secretary's Certificate/Board Resolution indicating the authorized signatory(ies) and the scope of authority.
- Articles of Incorporation
- Certificate of SEC that the articles of incorporation have been registered.
