I would like to request for my BIR 2316 from my previous employer, 
I need it to file BIR 1700 which is being ask by my current company.

Dear Mr. Marqueses,

I refer to my letter of Apr 13, 2022 04:15:15 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for BIR 2316.

Kindly clarify from your new employer if what they are asking from you is the BIR Form 2316 for CY 2020 as we have the impression that it is for the current year for them to do the year-end adjustment. Your new employer will take into consideration your income from previous employment and your tax liability will be based on your total income for the year.

Thus, you may directly request this from your employer as they are the main source of such documents. It is also mandated by law that every employer shall issue BIR Form No. 2316 to every employee before the close of such calendar year, or if employment is terminated, on the day on which the last payment of compensation is made.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Jul 06, 2022 06:11:03 AM, your request will be closed.

I no longer have contact with my previous employer and having issue visiting the site/company due to health protocols. I'm still not vaccinated as of the moment and my current employer is asking for my 2316 for 2021.

If there's a way to get a copy through this it would be much appreciated and if it's not possible please provide steps in order to get a copy with my given situation.
