I would like to request a copy of my BIR 2316 Form (Certificate of Compensation Payment/Tax Withheld) for the year 2021.

This is because it is one of the requirements needed by my new employer. I already requested a copy of my BIR 2316 to my previous employer, but they does not respond to my request. Thry haven't issued 2316 when I left the company since it was not available by that time. 

My last day at my previous employer was July 31, 2021 and my start date at my new employer was last September 21, 2021.

Dear Mr. Rufo,

I refer to my letter of Apr 13, 2022 12:14:16 AM about your request under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch, for Copy of my 2316.

Kindly clarify from your new employer if what they are asking from you is the BIR Form 2316 for CY 2021 as we have the impression that it is for the current year for them to do the year-end adjustment. Your new employer will take into consideration your income from previous employment and your tax liability will be based on your total income for the year.

Thus, you may directly request this from your employer as they are the main source of such documents. It is also mandated by law that every employer shall issue BIR Form No. 2316 to every employee before the close of such calendar year, or if employment is terminated, on the day on which the last payment of compensation is made.

During the period of us awaiting your reply, your request will be put on hold. If we do not receive a reply on or before Jul 06, 2022 06:14:11 AM, your request will be closed.
