Hi!

 I would like to know if infectious diseases (i.e. COVID-19) acquired at work (i.e. in a non-medical industry setting, general/industrial etc.)  can be classified as a "Disabling injury” (DOLE OSHS terminology) that may constitute for workers’ compensation claims as prescribed in Section 27 of the said standard? 

This is of course, assuming that it is already established that the employee somehow contracted the disease in the line of his duty/work site and caused temporary disabilities.

Your Request

You asked for Department Order No. 198 CHAPTER VI Section 27. DOLE Occupational Safety and Health Standards.

Infectious Diseases acquired at work may be considered as work-related or compensable. However, the benefit is not automatic and shall be subjected to evaluation of pertinent documents required for EC claims as medical abstract detailing the contributory factors in the development of the disease, employment certificate or job description, records of pre-employment and results of annual physical examination, make-up of the workplace, and other relevant documents that may prove that the condition was acquired by the worker in the performance of his/her job or was increased by the working conditions prevailing at the time prior to contracting the condition. For further information, you may check PD 626.

Your right to request a review
