Greetings,
Currently, the PE already has an ISP but wants to upgrade the speed, but instead of upgrading the speed, it will opt to procure another connection from a different provider with the same speed and cost thereby doubling the speed. Is there a certain provision prohibiting the procurement of an additional ISP from a different provider for augmentation?

Your Request

You asked for Procurement of 2 or more ISPs.

Response to Request

Your FOI request is approved. I enclose a copy of all of the information you requested.

PEs are not prohibited from bidding out its additional ISP, so long as the additional ISP is properly included the APP of the agency in accordance with Section 7.2 of RA No. 9184 and its 2016 Revised IRR. As a reminder, Section 10 of RA No. 9184 and its 2016 Revised IRR prescribes that all procurement shall be done through competitive bidding. Alternative methods may be resorted to only in highly exceptional cases subject to the approval of the Head of the Procuring Entity (HOPE), and whenever justified by the conditions provided in the law.

Your right to request a review
