Dear Ralph Herrera,

This pertains to your request for a copy of a sample indicative management plan for your reference. 

Please be advised that the State adopts and implements, under Section 28, Article II of the 1987 Constitution, a policy of full public disclosure of all its transactions involving public interest, subject to reasonable conditions prescribed by law. Furthermore, under Section 7 of its Article III, the Constitution also guarantees the right of the people to information on matters of public concern.

However, the right of the public to gain access to information, including those which are government – controlled, is not absolute. The State equally strengthens, through the Data Privacy Act of 2012 (RA 10173), the fundamental human right of privacy and of communication, while ensuring the free flow of information to promote innovation and growth. Hence, in the Memorandum of the Executive Secretary Salvador C. Medialdea, dated 24 November 2016, all government offices are instructed that information deemed confidential for the protection of the privacy of persons should be exempted to the right of access to information. Under the DENR Administrative Order No. 24, series of 1997, company profile and other application data provided by the clients of the DENR in the course of applying for various permits and agreements are regarded as confidential documents.

Relative thereto, this Office cannot provide you a sample of an approved indicative management plan, considering that some private information regarding the operations of the concerned business entity is included thereat.   Nevertheless, for your perusal, we have attached below the template that you must follow in formulating it, and the topics you are required to discuss thoroughly in the plan.
