May 8, 2023 Dear Leonardo Gabis, Thank you for your request dated May 05, 2023 07:29:43 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. You asked for bereavement leave act. Currently, no enabling law provides for bereavement leave in the Philippines. What the labor code provides is only the 5 days Service Incentive Leave. Bereavement leaves, Annual Vacation, Sick Leave, and other similar leaves are all part of the company's good practice or collective bargaining agreement. There were a number of Bills filed in the Senate and House of Representatives on the grant of - bereavement leave for the public and private sectors. The most recent is House Bill No. 4340, in which private and public sector employees would be entitled to seven days of paid bereavement leave following the death of a spouse, biological or adoptive parent or child, or a full or half-blood brother or sister. The proposed measure allows employees to take a leave from work to grieve and recover from the loss without sacrificing his/her income. Until the proposed law is enacted, the grant of bereavement leave for private sector employees shall remain voluntary.
