18 August 2023 Ms. Angel May Guzman San Andres, Manila Dear Ms. Guzman: This refers to your follow-up request for a copy of Presidential Directive No. 2022-016, entitled “Deferring Acceptance of New Applications for Reclamation Projects”, which you were informed was referred to the Office of President-Presidential Management Staff (OP-PMS) by the Philippine Reclamation Authority (PRA) on 30 May 2023. The OP-PMS has not received said referral from the PRA. Nonetheless, upon careful evaluation of the required information, the OP-PMS cannot favorably act on your request pursuant to Section 4 of Executive Order (EO) No. 02, s. 2016, which states that access to information shall be denied when the information falls under any of the exceptions enshrined in the Constitution, existing law, or jurisprudence. Related thereto, Memorandum Circular No. 15, s. 2023 states the exceptions to the right of access to information, as recognized by the Constitution, existing laws, or jurisprudence, including the following: 1. Information covered by Executive privilege, such as Presidential conversations, correspondences, and discussions in closed-door Cabinet meetings; and 2. Information, documents, or records known by reason of official capacity and are deemed as confidential, including those submitted or disclosed by entities to government agencies, tribunals, boards, or officers, in relation to the performance of their functions, or to inquiries or investigation conducted by them in the exercise of their administrative, regulatory, or quasi-judicial powers.
