Dear Mr. Ben Thatcher,
Greetings!
Thank you for your request dated Aug 20, 2023 04:35:11 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch data on migrant workers with disability and the programs of the Department of Migrant Workers to assist this particular group of individuals.
Mr. Thatcher we received four (4) inquiries from you for the period 15 and 20 August. Apparently you have not been doing your readings of secondary sources which is a requirement for doing a thesis/research.
It is obvious that you do not share our definition of migrant workers. The data of OWWA covers member-OFWs with a valid overseas employment contract (OEC) at the time of payment of contribution. Therefore, not all Filipino migrant workers are members of OWWA and logically not all migrant workers can avail of benefits and services from OWWA.
OWWA provides financial and repatriation benefits for active OWWA members who are medically/mentally challenged while overseas. However, we can only facilitate the assistance for the non-member through referral or representation with the employer or foreign placement agency. Visit OWWA's website: www//http: @owwa.gov.ph for a listing of programs and benefits.
It is strongly suggested that you open the different government website whose mandate has something to do with migrant workers. Moreover, familiarize yourself with R.A 8042 and R.A. 10022 to be more knowledgeable of the Migrant Workers Act and its amendment law.
If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by writing the OWWA- FOI Decision Makers at email: [email protected]. Your review request should explain why you are dissatisfied with this response and should be made within FIFTEEN (15) calendar days from the date you received this letter. We will complete the review and tell you the result within THIRTY (30) calendar days from the date we received your review request.
However, if you are still not satisfied with the result of the review, you then have the right to appeal to the Office of the President under Administrative Order No. 22 (s. 2011).

Thank you for your tongue and check response, I found the tone very entertaining.
I do apologize for causing you any strain, the reason that there are 4 requests, was because one was duplicated (I am unsure why - #OWWA-740713779432 and #OWWA-181402004896). Also, there is a very strict limit to words, so I had to put across 3 requests and tried to keep the points separate.
I am aware that two of the three requests may not be to your department but for the DMW in general. Unfortunately, the DMW are not an option on the FOI website, and the DMW did not respond to my formal letter for information after 4 months (though it got accepted and it passed on). Thus, I had no alternative but to come to you, I was pointed in your direction by staff. Though I do agree with you that the other two requests are not perfect for your mandate and that you may not be able to answer, I feel this one is.

I can assure you that I have done the readings of secondary sources which is a requirement for doing thesis/research, this is why I am asking for data here. I am fully aware of the R.A 8042 and R.A.10022.
I likely do share your definition of an OFW. I am specifically interested in OFWs with disabilities, (again there is a strict word limit - so I couldn't provide the context).
Sorry for the misunderstanding, the data I require is on OWWA members only, information that you have on migrants with disabilities, I am aware you cannot provide data on people you do not cover.
I want this as person with disabilities are often excluded from migration and are not a required data point - and not included in REPUBLIC ACT No. 10022, as persons with disabilities are only mentioned as insurance during disablement. When acquiring disability, may be the only time that data is collected on this vulnerable group. Thus, I am trying to get the data you do have on them.
Can you please provide me data on OWWA members who have acquired disabilities, I wanted to know if migrant who acquire disability, not just get financial compensation, but get opportunities to reintegrate into host society (as this is more important for long term wellbeing).
If there is better way to find out what information you have on disability, please share with me so I can improve my FOI requests in the future.
