Electronic-FOI (e-FOI) Terms and Conditions

The effective date of these terms and conditions is November 25, 2016. The Office of the President (OP) through the Presidential Communications Office (PCOO) will update these Terms and Conditions from time to time. You should therefore check the effective date each time you visit the site.

FOI Terms & Conditions

In using this e-FOI website, it is presumed that you have read and also agreed to the following terms and conditions: The following terminology applies to these terms and conditions, the Privacy Statement and Disclaimer Notice, and any or all agreements: "Client," "User," "you," or "You" refer to the person using this website by accepting the terms and conditions. "e-FOI," "We," and "Ourselves" refer to the Government of the Philippines. "Party," "Parties," or "Us" refer to both the parties, the client(s), and ourselves, i.e., those users accessing this website and availing of services, or any authorized person of the Government of the Philippines to do so. Any use of the above terminology or other words in the singular, plural, capitalization, and/or he, she, or they are taken as interchangeable and therefore as referring to the same. All the terms and conditions referred to hereto and hereafter are strictly and only for availing of the services of e-FOI online and not any other service.

e-FOI Privacy Statement

The information you provide on this form will be used by the agency you have applied to to deal with your application as set out in the Government of the Philippines, Freedom of Information Executive Order No. 2. If you have applied to a department or agency under the FOI EO only, once the department or agency receives a valid FOI access application, the date you applied and what you are applying for will be published online in their disclosure log. If the Department or Agency gives you access to a document, and if the document contains no personal information about you, the document will be published online in the Department’s or Agency’s disclosure log, along with your name and, if another person, company, or body will use or benefit from the documents sought, the name of that person, entity, or body. The department or agency may remove some information from the document before it is published—for example, information that may be defamatory. You may be required to provide certified copies of your identity or other documents for your application to be processed, and it is therefore recommended that you contact the relevant FOI officer to arrange this.

Data Privacy Act 2012 (Republic Act No. 10173)

In requesting information through an e-FOI request, the User is hereby consenting to the collection and storage of their personal information by the Presidential Communications Operations Office (PCOO) under the Data Privacy Act of 2012 (Republic Act No. 10173). The National Privacy Commission (NPC) will administer and implement the provisions of the Data Privacy Act of 2012 and monitor and ensure compliance with international standards set for data protection to effectively implement the provisions of the Act.

Copyright Notification

The information supplied to the User continues to be protected by the "Intellectual Property Code of the Philippines" (RA No. 10372). You are free to use it for your purposes, including any non-commercial research you are doing and for news reporting.  Any other re-use, for example, commercial publication, would require the permission of the copyright holder.  Most documents supplied by the Government of the Philippines will have been produced by government officials and will be copyrighted.  You can find details on the arrangements for re-using copyright material on the Intellectual Property Office of the Philippines website at: http://ipophil.gov.ph/ Information you receive that is not subject to copyright continues to be protected by the copyright of the person or organization from which the information originated.  You must ensure that you gain their permission before reproducing any third-party (non-copyright) information.

e-FOI Request for Philippine Citizens Only

Requests for information under Freedom of Information (FOI) Executive Order No. 2 are available only to citizens of the Philippines. By submitting an e-FOI request, you are confirming that you are a citizen of the Philippines and accepting all responsibility and/or possible liability that would entail making the request and future use of the information provided. In certain instances, you may be required to provide certified physical copies of your identity or other documents for your application to be processed, and it is therefore recommended that you contact the relevant FOI officer to arrange this.

Through e-FOI, the User will find URLs to other Internet websites, including advertisements, products, competitions, promotions, downloads, or other materials on or available from such external Internet sites or resources. The Presidential Communications Operations Office (PCOO) has no control over and is therefore not responsible for the availability of any such external Internet sites or resources. The Presidential Communications Office will not accept responsibility, directly or indirectly, for any actual or alleged damage or loss caused by, or in connection with, the use of, or reliance on any such content, goods, or services available on or through any such external sites or resources.

Any of these Terms and Conditions shall be determined invalid, unlawful, or unenforceable by any court of competent jurisdiction; any such Terms and Conditions shall be severed from the remaining Terms and Conditions, which shall continue to apply to the fullest extent permitted by law. These terms and conditions shall be governed by and construed under the laws of the Philippines.
