received a message that I have an overdue loan from Mocamoca lending app. Upon verifying, the number associated with the loan was 09754481202 which was my old unregistered sim card. I lost this simcard last June or July, when I lost my phone as well. I wasn't able to get a screenshot for it was deleted and I would like to inform that last year I was a victim of identity theft and I am afraid that my credentials and government numbers was used for this activity. I am humbly asking for help. They aslo mentioned to access my contact list, gallery and Facebook account.

You seek help due to the unauthorized access of your personal information by an online lending app.

Response to your request

While we aim to provide information whenever possible, in this instance, your inquiry is not a valid FOI request but a complaint to which the filing should follow our process under the NPC citizen’s charter.

Under Executive Order No. 2, s. 2016, it provides for the guidelines on full public disclosure and transparency in the public service which covers only access to information, official records, public records, and to documents and papers pertaining to official acts, transactions or decisions, as well as to government research data used as basis for policy development.

In this regard, complaints and request for clarification on data privacy violation should follow the guidelines provided in the citizen’s charter of our agency, which you may access here: https://www.privacy.gov.ph/citizens-charter/filing-a-complaint/

Nonetheless, to assist you with your concern, we have forwarded your inquiry, name, and email address to our Public Information and Assistance Division (info@privacy.gov.ph) for the drafting of an appropriate response.

You may expect our written response within 3-7 working days. However, if the concerned office determines that this may be a subject of an advisory opinion, the same will be released to you not later than 20 working days, unless the complexity and novelty of the subject matter require a longer period of time for further evaluation.

Your right to request a review

If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by writing to Privacy Commissioner and Chairman Atty. John Henry D. Naga at info@privacy.gov.ph. Your review request should explain why you are dissatisfied with this response and should be made within 15 calendar days from the date you received this letter.

We will complete the review and tell you about the result within 30 calendar days from the date we receive your review request.
