March 31, 2023 Dear Mr. Fernan: Greetings! Thank you for your request dated Mar 30, 2023 under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch. Your request You asked for Request for BIR Form 2136. Response to your request Kindly attach scanned copies of at least two (2) valid government I.D.s containing the photograph and signature of the requesting party [per Section 21.3 (a)] Chapter VII of the Revised People's Freedom of Information Manual. Since you are employed for the calendar year 2022, your EMPLOYER is required to issue a copy of your BIR Form 2316 for Calendar Year 2022 pursuant to Section 2.83.1 of Revenue Regulations No. 02-98, as amended which provides that “The EMPLOYER shall furnish each employee with the original copies of Form No. 2316 xxx.” As proof that your taxes were withheld. This will serve as your Income Tax Return (ITR). The BIR FORM NO. 2316 SHOULD BE ISSUE ON OR BEFORE JANAURY 31 FOLLOWING THE CALENDAR YEAR, OR, IF THE EMPLOYEE IS TERMINATED BEFORE THE END OF THE CALENDAR YEAR, ON THE DAY THE LAST SALARY OF THE EMPLOYEE IS PAID”.
