Hi would like to confirm if lastpay 30 calendar days processing is only suited for company with weekends work?
Pati ba company na walang pasok ng weekend should follow the 30 calenday days instead of 30 working days? Is it a little unfair or is it allowed to say na pwede mag working days sa ganitong case?

Dear Janien Tagabi,

Thank you for your request dated Mar 19, 2023 12:20:12 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

As a general rule, “days” shall mean “calendar days”. This means that Saturdays, Sundays, and Legal Holidays are included in the count. If it explicitly states “working days” or “business days”, then those three aren't counted.

Further, under Labor Advisory No. 6 Series of 2020, all employers are advised to release the final pay to their employees within 30 days from the date of separation or termination of employment, unless a more favorable company policy, or individual or collective agreement exists.
