Thank you for your request dated Sep 06, 2020 08:46:45 AM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.
You have asked for the following questions:
1. Why your company do not compensate the every 31st day of the month?
2. Why your company do not practice holiday pay?
Monthly-Paid Employees and Daily-Paid Employees Monthly-paid employees are those who are paid every day of the month, including unworked rest days, special days, and regular holidays. Factor 365 days in a year is used in determining the equivalent monthly salary of monthly-paid employees. Daily-paid employees are those who are paid on the days they actually worked and on unworked regular holidays.
Holiday pay refers to the payment of the regular daily wage for any unworked regular holiday. The law also provides for excemptions on the payment for holiday pay as those in retail and service establishments regularly employing less than ten (10) workers.
Based on the foregoing, the payment for the 31st day of the month may have already been included in the computation using 365 as the factor. As for the payment of holiday pay, the law provides for exceptions depending on the number of workers and nature of operations.
