Hello!

We in the National Electrification Administration are planning to switch from our current electricity provider (MERALCO) into Renewable Energy Supplier (RES) which is allowed under the Department of Energy DC2018-07-0019 or "Promulgating the Rules and Guidelines Governing the Establishment of the Green Energy Option Program (GEOP) Pursuant to the Renewable Energy Act of 2008". In view of this, we would like to know if we will follow the R.A. 9184 in procuring our new electricity provider. Thank you.

Your Request

You asked for Procurement Method for the Green Energy Option Program (GEOP).

Response to Request

Your FOI request is approved. Below is the answer to your query: 

Section 4.1 of the 2016 revised IRR of RA 9184 provides that the IRR of RA 9184  shall apply to all procurement of any branch, agency, department, bureau, office, or instrumentality of the Government of the Philippines (GoP), including government-owned and/or -controlled corporations (GOCCs), government financial institutions (GFIs), state universities and colleges (SUCs), and local government units (LGUs). 

RA 9184 shall apply to all procurements made by the GoP using public funds. Hence as long as public funds are used or contemplated to be spent to procure the services of the service provider (renewable), then it is covered by  RA 9184 and its IRR. (NPM 048-2015)

The foregoing reply was made based on existing particular facts presented and circumstances availing, and may not, therefore, be applicable given a different set of facts and circumstances.
