I would like to ask how, as a new company registered, make a formal filing/report that we have not hired any employees for the newly registered company. Pls, assist regarding the process and the forms needed to be filled out. Thanks!

This refers to your eFOI request received on 15 July 2022 via the eFOI portal of the Home Development Mutual Fund (Fund) wherein you inquired how a newly registered company may make a formal filing/report that it has not hired any employees. Further, you inquired on the process and the forms needed to be accomplished. However, it is not clear if the registration that you mentioned pertains to registration of the company with the Securities and Exchange Commission or registration with the Fund as an employer.    

Our Office deemed it proper to raise this matter to and confer with the operating unit concerned – the Member Services Sector Support Unit (MSSSU).

Section 24 (a) of Republic Act No. 9679 or the Home Development Mutual Fund Law of 2009 provides that each employer shall immediately report to the Fund the names, ages, civil status, occupations, salaries and dependents of its covered employees. Section 4, Rule V of the Implementing Rules and Regulations (IRR) of RA No. 9679 provides that the mandatory coverage of the employer shall take effect on the first day of his business operation, and that of the employee on the date of his or her employment.  Section 5, Rule V of the IRR further provides that all new employers shall first register with the Fund prior to the start of their business operations. Thus, we encourage you to register with the Fund if you have not yet registered. Upon registration, please advise the branch that you have not yet commenced business operations and still in the process of hiring your employees.  

Kindly be informed that per our MSSSU, no monthly report is required from the employers who still have no employees or are non-operational. 

Finally, pursuant to Section 6, Rule V of the IRR, it shall be the duty of all employers to register all their employees subject of mandatory coverage within thirty (30) days from the start of their business operations. For newly hired employees, the employer shall register them with the Fund within thirty (30) days from the start of their employment.
