25 November 2021 Dear MR. RANDOLPH VINCENT M. SISON, This refers to your eFOI request received on 09 November 2021 sent to the eFOI portal of the Home Development Mutual Fund (Fund) wherein you requested for information on a certain parcel of land located at Blk. 6 Lot 2 Citihomes Resortville 5, Dasmarinas Cavite (the “Property”). You further mentioned that the Property was acquired by your deceased father in 2014. Kindly be informed that Section 3 of Executive Order No. 2, series of 2016 (Executive Order) grants every Filipino citizen the right to access information, official records, public records and to documents and papers pertaining to official acts, transactions or decisions, as well as to government research data used as basis for policy development. In accordance with the aforementioned Executive Order, the Pag-IBIG Fund People’s Freedom of Information Manual (Manual) also states that “Information for Disclosure” includes: information promoting the awareness and understanding of policies, programs, activities, rules or regulations affecting the public, government agencies, and the community and economy (Section 2 of the Manual). In other words, the nature and subject of requests for information pursuant to Executive Order No. 2, series of 2016 refer to the right of Filipino citizens to information on matters of public concern. It excludes requests pertaining to personal transactions with the Fund, which necessarily involves disclosure of personal information. Considering that your request pertains to the personal transaction and record of your deceased father with the Fund, this is not covered under the aforementioned Executive Order and Manual. Further, we note that your request did not specifically allege the transaction/s your late father may have with the Fund (i.e. Provident Savings, Housing Loan, and/or Multi-Purpose Loans). In addition, may we inform your good self that for the legal heirs and assigns of the data subject invoking the transmissibility of the right of the data subject, the Fund may require the following documents for verification purposes: (a) Death Certificate of the data subject; (b) Birth Certificate of the legal heirs and assigns; and (c) other supporting documents to validate the authority and identity of the representatives as well as to confirm the identity of the requesting party.
