If yes, can I have a copy?

If no, why?

You asked for Statistics on Appeals t FOI Requests dated Apr 30, 2019

Response to your request

Please be informed of the formal guidelines for filing for an appeal as a remedy in case of denial.

 A person whose request for access to information has been denied may avail himself of the remedy set forth below: 

1. Administrative FOI Appeal to the PCOO Central Appeals and Review Committee: Provided, that the written appeal must be filed by the same requesting party within fifteen (15) calendar days from the notice of denial or from the lapse of the period to respond to the request. 

a. Denial of a request may be appealed by filing a written appeal to the PCOO Central Appeals and Review Committee within fifteen (15) calendar days from the notice of denial or from the lapse of the period to respond to the request. 

b. The appeal shall be decided by the PCOO Secretary upon the recommendation of the Central Appeals and Review Committee within thirty (30) working days from the filing of said written appeal. Failure to decide within the 30-day period shall be deemed a denial of the appeal. 

2. Upon exhaustion of administrative FOI appeal remedies, the requesting party may file the appropriate judicial action in accordance with the Rules of Court.  

Accordingly, there is no formal appeals (those appeals which followed the set guidelines as provided above) filed yet since the establishment of the eFOI Portal up to this date. However, the number of informal appeals (those who are only communicated directly to the FOI-PMO via email foi@pco.gov.ph and foi.pco@gmail.com) already accounts to 5 (five) filed with the same time frame as mentioned above. 

Moreover, please be guided that you can view the number of appeals filed in the agency through their FOI Reports which is uploaded in every Agency Transparency Seal.
