Hi, I would like to ask the status of House Bill 4113 and Senate Bill 1305 or the “105-Day Expanded Maternity Leave Law,”. The bicameral already ratified it last Nov 2018 according to latest news. I know that according to law, even if not signed by the president 
it will lapse into law after 30 days if there are no ammendments. My questions are:
1. When will the president sign it?
2. If it is not yet signed, is there anymore proposed ammendments after the 2nd ratification last Nov 2018? when will it lapse? Is it after 30 working days or calendar days?

Thank you for your request dated Jan 23, 2019 08:45:56 PM under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.

Your Request

You asked for House Bill 4113 and Senate Bill 1305 or the “105-Day Expanded Maternity Leave Law,”.

Relative to your request, please be informed that the inquired bills / proposed measure had already been enacted into law as Republic Act No. 11210, otherwise known as "An Act Increasing The Maternity Leave Period to One Hundred Five (105) Days For Female Workers With An Option To Extend For An Additional Thirty (30) Days Without Pay, And Granting An Additional Fifteen (15) Days For Solo Mothers, And For Other Purposes." which was signed by the President on 20 February 2019. You may access the said legislation as well as all the other laws and presidential issuances on the Official Gazette of the Republic of the Philippines (http://www.officialgazette.gov.ph). 

Also, may we seek for your indulgence and understanding for our inability to reply to your query immediately and within the prescribed period. Please be informed that the PLLO designated receivers were not able to access the e-FOI portal due to technical and administrative problems in the past year of implementation of the said portal. It was only this month, through the assistance of the PCOO that the PLLO was able to address these difficulties and hence access the portal.   


If you are unhappy with this response to your FOI request, you may ask us to carry out an internal review of the response by writing to Presidential Legislative Liaison Office addressed to Secretary Adelino B. Sitoy, LLB, LLM. Your review request should explain why you are dissatisfied with this response, and should be made within 15 calendar days from the date when you received this letter. We will complete the review and tell you the result within 30 calendar days from the date when we receive your review request.

If you are not satisfied with the result of the review, you then have the right to appeal to the Office of the President under Administrative Order No. 22 (s. 2011).
