Thank you for your request dated Aug. 16, 2024, made under Executive Order No. 2 (s. 2016) on Freedom of Information in the Executive Branch.
You have requested a copy of the memorandum of agreement between the agency and NBI/PNP regarding the non-reflection of a derogatory record in the clearance system of law enforcement agencies.
The agency does not have a MOA with NBI regarding such practice. The legal basis for such practice is DOJ Opinion No. 21, s. 1987 and DOJ Opinion No. 154, s. 1991.
For the PNP, the agency has a request for the former to adopt the practice of the NBI based on the said opinion. But the request is still under consideration as the same must be coordinated with the Secretary of the DILG. Enclosed, you will find a copy of the DOJ Opinions.
If you are dissatisfied with our response to your FOI request, you have the option to request an internal review. To initiate this process, kindly submit your written appeal for review addressed to Administrator Atty. Bienvenido O. Please provide a detailed explanation of your dissatisfaction with our response within 15 calendar days from the date of receiving this response. We will conduct the review and communicate the outcome within 30 calendar days from the receipt of your review request.
Should you remain unsatisfied with the review outcome, you retain the right to appeal to the Office of the President under Administrative Order No. 22 (s. 2011).
