Dear Requestor,
This refers to your FOI request received on 28 February 2024 via electronic mail and received by the eFOI receiving officer of the Home Development Mutual Fund (Fund) wherein you are requesting for historical data of home loans and top developers, specifically for the following information:
For the last 5 years (2018-2023), for each year:
1. Total home loans and total loan value disbursed;
2. Average loan size and average interest rate;
3. Names of the top 20 Pag-IBIG developers; and
4. Amount of home loans and total value disbursed for each of the top 20 developers.
Furthermore, you are requesting that data be broken down by category of house-socialized/economic/affordable Location – Region. According to you, the data will be used for market research. On 01 March 2024, we requested from you copy of your valid Philippine IDs for identification and records purposes. On the same day, you provided us with a scanned copy the following ID as proof of your identification: 1. Belgium Passport 2. Tourist Alien Certificate of Registration issued by the Republic of the Philippines.
In reply to your request, kindly be informed that Section 3 of Executive Order No. 2, series of 2016 (Executive Order) grants every Filipino citizen the right to access information, official records, public records and to documents and papers pertaining to official acts, transactions or decisions, as well as to government research data used as basis for policy development.
In accordance with the aforementioned Executive Order, the Pag-IBIG Fund People’s Freedom of Information Manual (Manual) also states that “Information for Disclosure” includes: information promoting the awareness and understanding of policies, programs, activities, rules or regulations affecting the public, government agencies, and the community and economy (Section 2 of the Manual).
In other words, the nature and subject of requests for information pursuant to Executive Order No. 2, series of 2016 refer to the right of Filipino citizens to information on matters of public concern. It excludes requests pertaining to personal transactions with the Fund, which necessarily involves disclosure of personal information.
The FOI provisions explicitly provides that they apply to and are intended for Filipino citizens while remaining silent on whether its provisions may be extended to foreign nationals. Thus, we are constrained to deny your request as it does not meet the criteria outlined for FOI requests.
